Enlargenet (“us”, “we”, or “Petqy”, which also includes its affiliates) is the author and publisher of the internet resource www.petqy.com (“Website”) on the world wide web as well as the software, services, on-site Hub facilities, mobile applications, and digital platforms provided by Petqy, including but not limited to the mobile application ‘Petqy’, the AI Pet Matching Engine, pet relocation/transport facilitation, pet walks, sitting, boarding, memberships, pet training (for pets and pet parents), grooming, party/photography studio services, veterinary services (in-house, online/tele-consultation, listed vet directory, EHR/health/vaccination record management, insurance/treatment assistance, and in-house/third-party lab diagnostics), pet rental/buy/adopt marketplaces, and the software, services, and applications under the brand name ‘Petqy’ (together with the Website, mobile applications, and on-site Hub facilities, referred to as the “Services”).

This privacy policy ("Privacy Policy") explains how we collect, use, share, disclose, process, and protect Personal Information, Sensitive Personal Data or Information, and Pet Profile Data about the Users of the Services, including In-House & Listed Veterinarians, Paravets, Groomers, Caregivers, Dog Walkers, Pet Sitters, Trainers, Transport Handlers, Diagnostic Lab Vendors, Breeders, Shelters, Rescue Organizations, and Pet Merchants (as defined in the Terms of Use, which may be accessed via the following web link https://petqy.com/terms (the “Terms of Use”)), Pet Parents, Pet Owners, Adopters, Buyers, Sellers, Renters, and visitors of the Website or Hub (jointly and severally referred to as “you” or “Users” in this Privacy Policy). We created this Privacy Policy to demonstrate our commitment to the protection of your privacy, your personal information, and your pet's health, electronic health records (EHR), lab diagnostic data, behavioral, genetic, and medical records. Your use of and access to the Services and Hub facilities is subject to this Privacy Policy and our Terms of Use. Any capitalized term used but not defined in this Privacy Policy shall have the meaning attributed to it in our Terms of Use.

CONSENT & ACCEPTANCE TERMS

BY USING THE SERVICES, ENROLLING YOUR PET, ACCESSING THE PETQY HUB, SCHEDULING VETERINARY CONSULTATIONS OR LAB TESTS, UPLOADING OR ACCESSING PET ELECTRONIC HEALTH RECORDS (EHR), PURCHASING MEMBERSHIPS, LISTING A PET FOR SALE/ADOPTION/RENTAL, UTILIZING THE AI MATCHING ENGINE, OR BY OTHERWISE GIVING US YOUR OR YOUR PET’S INFORMATION, YOU WILL BE DEEMED TO HAVE READ, UNDERSTOOD AND AGREED TO THE PRACTICES AND POLICIES OUTLINED IN THIS PRIVACY POLICY AND AGREE TO BE BOUND BY THE PRIVACY POLICY. YOU HEREBY CONSENT TO OUR COLLECTION, USE, SHARING, AND DISCLOSURE OF YOUR AND YOUR PET’S INFORMATION (INCLUDING MEDICAL RECORDS, ELECTRONIC HEALTH RECORDS [EHR], DIAGNOSTIC LAB RESULTS, VACCINATION HISTORIES, DIETARY NEEDS, GENETIC/BEHAVIORAL DATA, LIFESTYLE METRICS, HOUSEHOLD ENVIRONMENT DATA, AND LOCATION DATA) AS DESCRIBED IN THIS PRIVACY POLICY. IF YOU USE THE SERVICES ON BEHALF OF SOMEONE ELSE (SUCH AS ANOTHER PET OWNER) OR AN ENTITY (SUCH AS, BUT NOT LIMITED TO, A VETERINARY CLINIC, DIAGNOSTIC LAB, RESCUE ORGANIZATION, ANIMAL SHELTER, CEMETERY, TRANSPORTER, BREEDER, OR EMPLOYER), YOU REPRESENT THAT YOU ARE AUTHORISED BY SUCH INDIVIDUAL OR ENTITY TO (I) ACCEPT THIS PRIVACY POLICY ON SUCH INDIVIDUAL’S OR ENTITY’S BEHALF, AND (II) CONSENT ON BEHALF OF SUCH INDIVIDUAL OR ENTITY TO OUR COLLECTION, USE AND DISCLOSURE OF SUCH INDIVIDUAL’S, ENTITY’S, OR ASSOCIATED PET’S INFORMATION AS DESCRIBED IN THIS PRIVACY POLICY.

1. WHY THIS PRIVACY POLICY?

This Privacy Policy is published in compliance with, inter alia:

Section 43A and Section 79 of Information Technology Act, 2000
Digital Personal Data Protection Act, 2023 ("DPDP Act")
Regulation 4 of IT SPI Rules, 2011
Rule 3(1) of IT Intermediary Guidelines, 2021

This Privacy Policy states the following:

  • The type of information collected from Users, Pet Parents, and Third-Party Service Providers, including Personal Information, Sensitive Personal Data or Information (as defined under applicable law), and Pet Profile Data (including veterinary medical records, Electronic Health Records [EHR], diagnostic lab reports, vaccination histories, dietary requirements, behavioral profiles, genetic traits, and household environment metrics);
  • The purpose, means, and modes of collection, usage, processing, retention, and destruction of such human and pet-related information;
  • How and to whom Petqy will disclose such information; and
  • The legal disclaimers and scope governing Petqy’s role as a peer-to-peer digital intermediary, veterinary tele-consultation platform, diagnostic service aggregator, and physical facility provider.

2. COLLECTION OF PERSONAL, PET & VETERINARY HEALTH INFORMATION

Generally, some of the Services require us to know who you and your pet are so that we can best meet your needs. When you access the Services, visit the Petqy Hub, utilize our AI Pet Matching Engine, book veterinary/lab/grooming/boarding/training/walking/sitting services, upload health or insurance records, list or inquire about pets, or through any interaction with us via emails, telephone calls, mobile application inputs, or other correspondence, we may ask you to voluntarily provide us with certain information that personally identifies you or your pet, or could be used to personally identify you or your pet. You hereby consent to the collection of such information by Petqy. Without prejudice to the generality of the above, information collected by us from you may include (but is not limited to) the following:

Contact Data: Such as your name, email address, telephone number, mailing address, and emergency contact details;
Demographic Data: Such as your gender, date of birth, pin code, occupation, family size, household members, and presence of children or elderly individuals;
Pet Electronic Health Records (EHR) & Clinical Data: Species, breed, age, color, weight, microchip ID, temperament, behavioral traits, food and dietary preferences (e.g., vegetarian/vegan household or specific protein diets), genetic history, physical medical records, clinical notes, digital prescriptions, surgical history, treatment plans, immunization/vaccination logs, and chronic illness history;
Diagnostic & Laboratory Data: Diagnostic lab reports, blood work, urine/stool analysis, digital X-rays, ultrasound scans, allergy panels, and biopsy reports generated in-house at the Petqy Hub or shared by third-party diagnostic lab vendors and partner clinics;
Insurance & Financial Claims Data: Pet insurance carrier details, policy numbers, claim history, billing invoices, pre-authorization requests, and reimbursement documentation shared for facilitating insurance claims and treatment assistance;
Veterinary & Tele-Consultation Data: Audio, video, and text chat logs from online vet consultations, clinical feedback, second opinions, prescriptions issued by in-house or listed third-party veterinarians, and appointment histories;
AI Matching & Household Environment Data: Home architecture type (e.g., apartment, villa, farm), square footage, availability of indoor/outdoor space, balcony and window safety/netting features, daily activity levels, time spent away from home, vacation schedules, travel habits, and interaction preferences with pets;
Services, Care & Lifestyle Usage History: Data regarding your usage of the Services, history of appointments, dog walks, sitting bookings, boarding stays, grooming sessions, photography studio sessions, pet/parent training modules, relocation/transport requests, membership tier usage, and peer-to-peer marketplace listings made by or with you through the use of Services;
Peer-to-Peer & Rental Data: Listing details for peer-to-peer buying, selling, adoption, or short-term/trial/therapy/event rentals posted by users or third-party organizations;
Voluntary Submissions: Other information that you voluntarily choose to provide to us (such as information shared by you with us through emails, chat logs, reviews, or physical forms) including images, party media, videos, audio recordings, and documents/files; and
Provider & Partner Data: Data shared by In-House and Listed Veterinarians, Paravets, Groomers, Trainers, Walkers, Sitters, Diagnostic Labs, and Transport Handlers pertaining to the treatment, care, or logistics availed by your pet.

The information collected from you by Petqy may constitute ‘personal information’ or ‘sensitive personal data or information’ under the SPI Rules and the DPDP Act.

“Personal Information” is defined under the SPI Rules to mean any information that relates to a natural person, which, either directly or indirectly, in combination with other information available or likely to be available to a body corporate, is capable of identifying such person.

The SPI Rules further define “Sensitive Personal Data or Information” of a person to mean personal information about that person relating to:

  • • Financial info (bank, credit/debit cards)
  • • Physical, physiological & mental health
  • • Sexual orientation
  • • Medical records and history
  • • Biometric information
  • • Information under lawful contract
  • • Visitor registration details
  • • Call data records

Petqy will be free to use, collect, process, and disclose information that is freely available in the public domain or designated as non-personal/anonymized pet medical and behavioral data without your explicit consent, subject to applicable legal frameworks.

3. PRIVACY STATEMENTS & LEGAL SCOPE BY SERVICE VERTICAL

3.1 VETERINARY SERVICES, EHR, LAB DIAGNOSTICS & INSURANCE ASSISTANCE

In-House Vets, Online Consultations & Listed Directory: Petqy provides access to in-house veterinarians at the Petqy Hub, connects users to veterinarians online via tele-consultation tools, and lists independent third-party veterinarians and clinics. Petqy acts as a technology platform for online consultations and directory listings. While Petqy ensures verification of internal staff credentials, listed independent veterinarians are solely responsible for their clinical diagnoses, prescriptions, and advice.

Electronic Health Records (EHR) & Vaccination Management: Petqy maintains a digitized EHR repository to help pet parents store, organize, and access medical records, vaccination schedules, prescription histories, and treatment logs. By uploading or consenting to the collection of EHR data, you authorize Petqy to store, process, and share these records with treating in-house vets, online consulting practitioners, emergency care centers, and onboard paravets to deliver seamless healthcare.

In-House & Third-Party Laboratory Diagnostics: Diagnostic testing is conducted through Petqy’s in-house laboratory facilities at the Hub as well as partner third-party laboratory vendors. You consent to the sharing of sample data, test requisitions, and diagnostic results between Petqy, third-party diagnostic labs, and your designated attending veterinarian for report generation and clinical analysis.

Insurance & Treatment Assistance: Petqy assists pet parents in maintaining organized treatment documentation, itemized billing, and diagnostic reports to support pet insurance claims and financial assistance workflows. Petqy does not underwrite insurance policies and is not an insurance company; claim approval remains at the sole discretion of your insurance provider.

3.2 INTERMEDIARY STATUS & THIRD-PARTY MARKETPLACE DISCLAIMERS

(Applies to all Peer-to-Peer Listings, Rentals, Adoptions, Sales, and Third-Party Services)

Intermediary Status (IT Act Sec 79): Petqy operates purely as a Peer-to-Peer Digital Intermediary and venue platform under Section 79 of the Information Technology Act, 2000, and Rule 3(1) of the IT Intermediary Guidelines Rules, 2021. Petqy provides a digital software platform connecting independent buyers, sellers, adopters, renters (including short-term, trial, therapy, and event rentals), shelters, rescue organizations, breeders, trainers, walkers, sitters, and transporters ("Third-Party Content Providers"). Petqy does not own, breed, rent, sell, buy, handle, or control third-party listed animals or services, nor does it act as an agent for any third party.

Statutory Compliance Responsibility: Indian laws, including the Prevention of Cruelty to Animals Act, 1960, Pet Shop Rules, 2018, and Dog Breeding and Marketing Rules, 2017, regulate animal welfare and handling. It is the sole statutory responsibility of third-party posters (individuals, breeders, pet shops, shelters, NGOs) to maintain valid registration with the Animal Welfare Board of India (AWBI), municipal authorities, PAN/GST authorities, and local licensing bodies. Petqy does not independently verify, guarantee, or audit the statutory licenses, legal standing, health disclosures, or claims of third-party listers.

Pet "Rent-to-Try" & Event Rentals: For short-term pet stays, trial rentals, therapy rentals, or film/event rentals, Petqy acts solely as a listing software platform. Animal welfare, housing conditions, safety compliance, and legal care standards rest entirely between the rental provider and the renter. Petqy assumes zero liability for animal distress, injury, contractual breaches, or legal disputes arising from rental or trial arrangements.

Third-Party Disclaimers: Petqy explicitly disclaims all liability for the accuracy, truthfulness, animal health status, pedigree claims, or legality of peer-to-peer listings. Users interact with third-party buyers, sellers, adopters, or service providers entirely at their own risk.

3.3 HUB CARE SERVICES: WALKS, SITTING, BOARDING, MEMBERSHIPS & PARTIES

Walks, Sitting & Boarding Care: Services conducted at the Petqy Hub or designated locations are managed under strict safety and hygiene protocols. Petqy collects health, behavioral, social compatibility, and dietary preferences to ensure pet safety during group walks, outdoor park play in our 24,000 sq. ft. park, pet sitting, and boarding stays in shared or private verandah suites.

Memberships & Tier Perks: Petqy processes tier registration data (Silver, Plus, Royal, Imperial) to manage park passes, spa entitlements, peak-season boarding guarantees, complimentary vet visits, and transferable member benefits.

Pet Photography Studio & Birthday Parties: Media captured during photography studio sessions or birthday celebrations hosted at the Hub (including photos, videos, and guest pet media) may be processed for physical print production (e.g., 8x10 framed prints), digital delivery, or promotional display, subject to user preferences.

3.4 TRAINING (PETS & PET PARENTS) AND RELOCATION

Training Programs: Petqy offers pet behavioral training and pet parent education delivered on-site at the Hub, virtually via the app, or at home. Training is conducted by internal employees, independent certified contractors, collaborators, and third-party experts. Petqy oversees programs conducted directly at the Hub but disclaims liability for independent or uncredentialed third-party training methods conducted outside official Hub workflows.

Pet Relocation & Logistics: Petqy facilitates local and global pet relocation via road, rail, air, and sea through internal operations and third-party logistics carriers. Petqy processes passport details, international health certificates, customs declarations, and microchip logs solely to execute transit logistics. Petqy disclaims liability for third-party carrier delays, flight disruptions, customs impoundments, quarantine orders, or transit injuries occurring during third-party transport.

3.5 GENERAL PROVISIONS FOR ALL USERS

Condition of Use: Acceptance of the Terms of Use and this Privacy Policy is required to access the Services. Users who do not agree must immediately discontinue using the platform and Hub facilities.

Usage Purposes: Information provided to Petqy is used for service delivery, medical record management, AI model training, algorithmic matching, aggregated research, communication, customer support, and billing processing.

Communication Consent: By registering or verifying your phone number, you explicitly consent to receiving transactional, operational, medical reminder, and promotional communications via call, SMS, WhatsApp, email, or push notifications, notwithstanding registration on DND/NCPR registries.

Accuracy & Account Management: Users are responsible for updating their personal, contact, and pet health data. Requests for updates or deactivation should be sent to vineet@petqy.com.

Data Security & Retention: Petqy employs industry-standard technical, managerial, and physical controls to protect data. Information is retained as long as required for service delivery or compliance, after which it may be anonymized for analytical and clinical research.

4. CONFIDENTIALITY AND SECURITY

Storage & Access: Personal, Veterinary EHR, and Diagnostic Information is stored electronically on Petqy’s secure servers, cloud infrastructure, and internal clinical management systems. Access is strictly limited to authorized personnel, attending veterinarians, clinical staff, and trusted third-party service providers on a need-to-know basis under strict confidentiality terms.

Password Security: Users must maintain the security of their account credentials. Immediately notify vineet@petqy.com of any suspected unauthorized access.

Sharing Medical Data for Animal Welfare: Petqy reserves the right to share relevant medical, vaccination, and emergency contact records with attending emergency clinics, veterinary hospitals, or animal welfare authorities when necessary to protect the life or health of an animal.

Third-Party & Cyber Risks: Petqy is not liable for security breaches, unauthorized device access, or technical failures occurring beyond its reasonable control.

5. CHANGES TO THIS PRIVACY POLICY

Petqy reserves the right to modify this Privacy Policy at any time. Material updates will be notified via website notices, app alerts, or direct email communications. Continued use of the Services following notification constitutes acceptance of the revised Privacy Policy.

6. CHILDREN'S AND MINORS' PRIVACY

The Services are not intended for unsupervised use by minors under 18 years of age. Petqy does not knowingly collect personal information directly from minors without verified parental or guardian consent.

7. CONSENT TO THIS POLICY

By accessing the Website, downloading the App, visiting the Petqy Hub, utilizing veterinary/EHR services, or enrolling in any Service, you unconditionally signify your assent to this Privacy Policy and consent to the collection, processing, storage, and sharing of your Personal Information and Pet Profile Data as outlined herein.
